Dikutip dari Hukum Online, menurut R. Soesilo zinah adalah “persetubuhan yang dilakukan oleh laki-laki atau perempuan yang telah kawin dengan perempuan atau laki-laki yang bukan isteri atau suaminya”.

Kitab Undang-Undang Hukum Pidana (KUHP) Pasal 284 menghukum pelaku zin-ah dengan hukuman maksimal 9 bulan penjara.

Ada sejumlah aspek hukum mengenai zin-ah ini, yakni:

1. Yang disebut zi-nah adalah hubungan pe-rse-tu-bu-han di luar nikah antara dua orang yang salah satu atau keduanya telah menikah.

2. Pe-rzin-ah-an harus bisa dibuktikan dengan (a) pengakuan tersangka -, dan/atau (b) saksi mata, yang dalam hukum Islam harus memenuhi persyaratan: 4 orang lelaki dewasa yang menyaksikan adanya penetrasi hub-un-gan s-ek-su-al.

3. Kasus zin-ah adalah delik aduan. Hanya pasangan resmi dari pelaku pe-rz-n-ah-an yang berhak melaporkan tindak pe-rzi-na-han. Polisi tidak berhak menangkap pelaku pe-rzi-n-h-an tanpa laporan dari pasangan resmi pelaku pe-rzi-na-han.

4. Pada perceraian karena alasan pe-rz-ina-han, mantan suami istri tidak bisa rujuk.

5. Meski yang melaporkan pe-rz-ina-han adalah pasangan resmi dari salah satu tersangka pe-rzin-ahan, proses hukum mengenai dua (atau lebih) orang yang terlibat dalam pe-rzi-na-han.

6. Per-zina-han dilakukan atas dasar suka sama suka tanpa adanya paksaan dari siapa pun.

Sanksi dari hukum pers-eling-kuhan oleh PNS

Pada kasus pe-rzi-nah-an yang dilakukan oleh seseorang berstatus Pegawai Sipil Negara (PNS), selain hukuman pidana yang termuat dalam KUHP, pelaku juga akan dikenai sanksi disiplin berat.

Alasannya, per-zin-ah-an bisa dikategorikan sebagai pelanggaran terhadap Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil Pasal 3 angka 6, yakni, setiap PNS wajib “menjunjung tinggi kehormatan negara, Pemerintah, dan martabat PNS.”

Atas pelanggaran tersebut, menurut Pasal 10 angka 4, pelaku akan diberi sanksi berat berupa:

1. Penurunan pangkat setingkat lebih rendah selama 3 (tiga) tahun.

2. Pemindahan dalam rangka penurunan jabatan setingkat lebih rendah.

3. Pembebasan dari jabatan.

4. Pemberhentian dengan hormat tidak atas permintaan sendiri sebagai PNS.

5. Pemberhentian tidak dengan hormat sebagai PNS.

Jika tersangka pe-rzin-ah-an adalah PNS, selain melapor kepada polisi, pasangan resmi bisa melapor kepada atasan pelaku di lembaga pemerintah tempatnya bekerja.

Bagaimana jika per-seli-ngk-uh-an itu tidak mengan-dung pe-rzi-nah-an?

Jika pasangan resmi sudah sangat kesal dan ingin membawa pasangannya yang b-er-seli-ng-kuh ke meja hijau, tetapi tersangka dalam posisi tidak be-rzin-a atau yang melapor tidak memiliki bukti atas p-er-in-aan, ada aturan lain yang bisa dipakai.

Pertama, jika pers-elin-gku-han itu (1) terjadi melalui media elektronik dan (2) mengandung hal yang melanggar kesusilaan, data elektroniknya bisa menjadi bukti untuk menyeret tersangka ke polisi.

Aturan yang dipakai adalah UU ITE Pasal 27 ayat 1 berbunyi, “Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan yang melanggar kesusilaan.”

Kedua, jika perselingkuhan tidak terjadi melalui media elektronik, hukum lain yang bisa dipakai adalah KUHP Pasal 335 tentang perbuatan tidak menyenangkan.

Pasal ini juga bisa dipakai pada orang lain yang dinilai mengganggu keharmonisan rumah tangga atau bahkan merebut pasangan orang.
